Appealing a transport decision made under the VEA

If you do not agree with a decision we have made under the VEA (for example, we did not reimburse you the amount you thought you should receive) you can ask to reconsider our decision.

A request to reconsider must:

  • be in writing (such as in a letter or in the General Enquiries form)
  • set out the grounds on which the request is made (for example, “I am requesting a review because…”)
  • be made within 3 months after the day that we notified you of the decision.

The person who made your original decision will not take part in the reconsideration.

If you do not agree with the outcome of the reconsideration, you can appeal to the Administrative Review Tribunal (ART).

Appealing a transport decision made under the MRCA or the DRCA

If you do not agree with a transport decision we have made under the MRCA or the DRCA, you can ask for a review or reconsideration.

To do this, you will need to follow the steps outlined in our page Reconsideration and review of compensation decisions.

If the decision was made under the DRCA, you must apply for a reconsideration within 30 days of receiving your decision letter.

If the decision was made under the MRCA, you must apply for a review within 12 months of receiving your decision letter.
